Please read these Terms and Conditions carefully before using TaxInvestInsure ("the Platform"), operated by SMART MONEY. By accessing or using our services, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account or using any part of our platform, you confirm that you are at least 18 years of age, have read and understood these terms, and agree to comply with them. If you do not agree, please do not use our services.

2. Description of Services

TaxInvestInsure provides the following services:

  • ITR Filing: Preparation and filing of Income Tax Returns (ITR-1, ITR-2, ITR-3, ITR-4) with the Income Tax Department of India
  • Mutual Fund Advisory: Goal-based investment planning and SIP recommendations as an AMFI-registered Mutual Fund Distributor
  • Insurance Advisory: Term life, health, and other insurance recommendations as an IRDAI-licensed advisor
  • NPS Advisory: National Pension System account setup, fund selection, and contribution guidance
  • Document Management: Secure upload, storage, and sharing of financial documents between clients and CA team

3. User Obligations

As a user of the platform, you agree to:

  • Provide accurate, complete, and up-to-date information. Providing false or misleading information may affect your tax filings and is an offence under the Income Tax Act.
  • Keep your login credentials confidential. You are responsible for all activity under your account.
  • Upload only legitimate documents that belong to you or for which you have legal authority
  • Not use the platform for any illegal purpose
  • Notify us immediately of any unauthorised access to your account

4. Fees & Payments

Service fees are communicated separately during onboarding and are subject to change with prior notice. All fees are inclusive of GST unless stated otherwise. We do not currently process payments online — fees are collected via bank transfer or other agreed methods. There are no refunds for services already rendered.

5. Intellectual Property

All content on the platform — including text, design, code, calculators, and tools — is the property of SMART MONEY and is protected under Indian copyright law. You may not reproduce, redistribute, or create derivative works without our written permission. The financial calculators provided are for informational purposes only and do not constitute financial advice.

6. Disclaimer of Warranties

Our services are provided "as is." While we strive for accuracy, we do not guarantee that:

  • Calculator results are error-free or applicable to your specific situation
  • Mutual fund returns will match projected estimates (past performance is not indicative of future results)
  • Insurance premium estimates will match actual insurer quotes
  • The platform will be available without interruption

Mutual fund investments are subject to market risks. Please read all scheme-related documents carefully before investing.

7. Limitation of Liability

To the maximum extent permitted by law, SMART MONEY shall not be liable for:

  • Any loss or damage resulting from errors in information you provide
  • Investment losses arising from market fluctuations
  • Loss of data due to circumstances beyond our reasonable control (force majeure)
  • Any indirect, incidental, or consequential damages

Our total liability to you for any claim shall not exceed the fees paid for the relevant service.

8. Termination

We reserve the right to suspend or terminate your account if you violate these terms, provide false information, or engage in fraudulent activity. You may also close your account at any time by contacting us. Termination does not affect our obligation to retain records as required by law.

9. Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through mutual discussion in the first instance. If unresolved, disputes shall be subject to the jurisdiction of courts in Nagpur, Maharashtra, India, under the laws of the Republic of India.

10. Amendments

We may update these Terms and Conditions at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised terms. We will notify registered users of material changes via email.

11. Governing Law

These terms are governed by the laws of India, including but not limited to the Information Technology Act 2000, the Income Tax Act 1961, SEBI regulations, and the Digital Personal Data Protection Act 2023.
